The Mendoza justice system arrested Federico Soria and Mauricio Cornejo, recognised leaders of the Asambleas por el Agua Pura (Assemblies for Pure Water). These arrests are a scandalous political persecution against the people of Uspallata, who mobilised massively against the reactivation of the San Jorge mining company since the beginning of the year. More than 160 organisations are demanding the release of Soria and Cornejo.
COMMUNIQUE:
We, the undersigned organisations, denounce the harassment and persecution against those who defend the territory against the advance of large-scale extractive metalliferous mining in Mendoza and throughout the country.
This time, the State, Minera San Jorge of Solway Holding and the Chamber of Mining Suppliers criminalise those who resist plunder and defend water, the environment and life. We know that intimidation strategies seek to sow fear in order to prevent communities from organising and actively participating in resistance to production models that go against their choice of life. Governments identify certain people they consider to be in leadership roles and then persecute, stigmatise, discredit and prosecute them in order to generate fear and demobilisation. These actions are not isolated or random, but are part of a systematic plan to weaken the collective struggle and pave the way for the plundering and surrender of our territories.
Furthermore, the struggle to defend water is being waged by disseminating scientific information and detailed knowledge of the territory that the governments promoting extractivism do not want it to be known. These manoeuvres are aimed at silencing the historic struggle of peoples such as the people of Mendoza, La Rioja and Chubut, who have repeatedly expressed their rejection of mega-mining by preventing the activity from happening.
Extractive models are always imposed with violence, and the judicialisation of protest and the stigmatisation of those who participate in it is a serious violation of the fundamental rights of expression, participation and organisation. Furthermore, Article 9 of the Escazú Agreement establishes the obligation of States to guarantee a safe environment for environmental defenders, protecting them from threats, persecution and violence. Argentina, as a signatory country, must comply with this commitment instead of criminalising those who defend the environment and human rights such as access to drinking water.
For all of the above reasons and in view of the detention of our comrades from the Uspallata Assembly, Federico Soria and Mauricio Cornejo, we DEMAND:
- The unprosecution and immediate release of those who have been criminalised for defending water and territory. Being unjustly charged with ‘belonging to an organisation that seeks to impose its ideas through terror’ (Art. 213 CP).
- The resignation of the Governor of Mendoza, Alfredo Cornejo, the Vice Governor of Mendoza, Hebe Casado, the Minister of Energy and Environment, Jimena Latorre, the President of Impulsa Mendoza, Emilio Guiñazú, the Director of Mining, Jerónimo Shantal and the Mayor of Las Heras, Francisco Lo Presti. Because they are responsible for ideological persecution, public intimidation and culpable damages to the psychological and physical health of the detainees.
- That the prosecutor Juan Manuel Sánchez be dismissed for non-compliance with Constitutional Guarantees, criminalisation and imprisonment without evidence.
- To the Judiciary to ensure compliance with the Constitution, laws and international treaties in force in Argentina. Namely, Art. 41 of the National Constitution, Provincial Law No. 7722, Civil and Political Rights, the Escazú Agreement and ILO Convention 169.
- The cessation of persecution and that the State guarantees that all people can exercise their right to peacefully defend the territory without fear of any kind of reprisals.
- That the self-determination of peoples be respected.
